
In Pune, a 70-year-old retired government employee was convicted by the court of special judge K P Kshirsagar for sexually assaulting a seven-year-old school girl at a construction site on October 31, 2019. The accused was sentenced to 20 years of rigorous imprisonment and fined Rs 10,000. The court found the victim, who was a second-grade student at the time, to be a credible witness with a good understanding of her obligation to tell the truth. The prosecution presented evidence that the accused lured the victim with his pet dog before committing the assault. The elderly man received concurrent sentences of five years for kidnapping, three years for sexual harassment, and another five years for aggravated sexual assault. The court did not impose a separate punishment for rape under the relevant law, and ordered the Pune district legal services authority to provide compensation to the victim. Judge Kshirsagar noted in the judgment that the evidence presented by the victim, her family, and other witnesses was consistent and credible, pointing to the accused's motive of gaining pleasure through the assault. The victim reported the incident to her mother immediately, and the Vishrantwadi police promptly registered an FIR. Medical examination confirmed the sexual assault, further strengthening the prosecution's case. The judge concluded that the prosecution had successfully proven its case beyond reasonable doubt.There were doubts surrounding the case as Special public prosecutor Nitin Konghe questioned 10 witnesses, including the victim and her mother, in order to establish the accused's guilt. The prosecution requested the harshest punishment for the accused due to his involvement in a serious crime.
